We value the privacy of our members and others who visit the Site and use our other products or services (individually, "You" or collectively, "Users"). We take your privacy seriously and make it a priority to protect personal information that we obtain from and about our Users.
This privacy policy (this “Privacy Policy”) describes:
1. what information we gather from you;
2. how and why we use your information;
3. to whom your information may be disclosed;
4. how we protect your information;
5. updating, accessing, deleting and retaining your information, and
6. providing or withdrawing your consent to our collection, use or disclosure of your information.
Whether or not you are a holder of an account on the Site (a “Member”), by using our products or services you expressly consent to the information handling practices described in this Privacy Policy. If you do not want information about you to be used in the manner set forth in this Privacy Policy, please do not use our products or services.
This Privacy Policy is incorporated into and is subject to our Terms of Use. Your use of our products or services and any personally identifiable information (such as your full name, credit card information and e-mail address) (“Personally Identifiable Information”) and other data provided by you and/or collected by us when you are accessing the Site or using our other products or services (such data, together with your Personally Identifiable Information, “Personal Information”) is subject to the terms of this Privacy Policy and the Terms of Use. Any capitalized terms used but not defined herein shall have the meaning set forth in the Terms of Use.
- What Information We Collect
- Information that you provide. When you register for, browse and use the Site or any of our other services, you may provide us with personally identifiable information. From time to time, we may also ask you optionally to provide other information. If you choose to provide such information, during registration or otherwise, you are giving us the permission to use and store such information as provided in this Privacy Policy.
- Information collected via cookies. When you visit our Site we may use cookies to track information about your browser’s activities and to provide you with better services and features on our Site. The types of cookies that we may use are "session cookies" and "persistent cookies".
- Session cookies: Session cookies store information only for the length of time that you are connected to a website – they are not written onto your hard drive. Once you leave the website, they expire and are no longer active. - Third-Party Web Beacons. We may also implement third-party content on the Site that uses "clear gifs," "web beacons," or other similar techniques, which allow third-party content providers to read and write cookies to your browser, or implement similar tracking mechanisms, in connection with your viewing of that third-party content displayed on the Site. This information is collected directly by the third-party, and we do not participate in that data transmission. Information collected by third parties in this manner is subject to that third-party's own data collection, use, and disclosure policies.
- Your relationship with us. We will collect information arising from your relationship with and through us and your use of our products and services. For example, we will maintain a record of your Credit balance, transaction history and payment history. As well, when you send us an e-mail, speak with one of our telephone service representatives, or communicate with us through any other means, we may monitor, record and retain those communications for our mutual protection and in order to process your inquiries, respond to your requests and improve our services.
- Information from Other Sources. We may also obtain information, including Personally Identifiable Information, from third parties and sources other than the Site. If we combine or associate information from other sources with Personally Identifiable Information that we collect through our services, we will treat the combined information as Personally Identifiable Information in accordance with this Privacy Policy.
- How and Why Your Personal Information is Used.
- To Serve you. We use the information that you provide or that we collect in order to provide our products and services to you and to establish and enhance our relationship with you. We generally use the information you provide or that we collect to operate, maintain, enhance, and provide our products and services.
- Aggregate Information. We may generate non-identifying and aggregate profiles from the information you provide during registration and through your use of our products and services. Non-identifying and aggregate profiles are used to improve the quality of our products and services and to develop new services and products. Aggregated non-personally identifying information may be shared with third parties.
- Marketing and Experience. If you have given us consent, we may use your Personally Identifiable Information to provide you with information about our features, services and other offerings that may be of interest to you. We may also send information or offers to groups of Users on behalf of other businesses. We may share your Personally Identifiable Information with certain other websites that we link to (and that you click upon) in order to enhance your experience in connection with the Site.
- To Whom your Personal Information may be disclosed.
- Our subsidiaries or affiliates. We may share your Personal Information with our subsidiaries or affiliates (the “Group”) for legal and regulatory purposes, to manage business risks, to perform analytics, to ensure that we have correct and up to date information about you and to the extent necessary if you have requested a product or service that is jointly offered by more than one member of the Group.
- Suppliers. We may use other companies to provide services on our behalf. These companies will only be given the information needed to perform those services. We have contracts in place holding these companies to the same standards of confidentiality by which we are governed. Our suppliers may perform activities outside of Canada. As a result, your information may be securely used, stored or accessed in other countries and may be subject to the laws of those countries. - Merger or sale. In the event that we are acquired by or merged with a third-party entity, or if we sell a part of the our business, we reserve the right to transfer or assign the Personal Information that we have collected from you as part of such merger, sale or other change of control.

We may disclose your Personal Information if we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation, self-regulation, legal process or enforceable governmental request. Note that we may process your Personal Information on our servers in Ontario, Canada and in other countries as may be necessary. For example, if you have registered as a Member and given us consent, we may share your Personally Identifiable Information with business partners and other entities that are not affiliated with us who would like to send you information about their products and services. We do not share Personally Identifiable Information with other third-party organizations for their marketing or promotional use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in.
- User Postings on the Site. The Site enables you to share your Content publicly on the Site. If your Content is shared with other Users, any Personally Identifiable Information that you choose to include in, or which is associated with, such Content will be accessible by such Users. Once you make your Personally Identifiable Information available to others in any of these ways, it may be collected and used by the recipients without restriction.

- Updating, Accessing, Deleting and Retaining your Personal Information.
- Updating your Personal Information. If you register as a Member of the Site, you may update, correct, or delete your profile information and preferences at any time by going to your account settings page.
- Accessing and deleting your Personal Information. We make good faith efforts to provide you with access to your Personally Identifiable Information and to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual Users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. We will advise you of any applicable fee prior to proceeding with your request.
- Retention of your Personal Information. We retain your Personal Information only as long as it is required for the reason(s) that it was collected. This length of time will vary depending on the product or service and the nature of the information and may extend beyond the end of your relationship with us. You may opt out of receiving such communications from us at any time by clicking on the "unsubscribe" link in any such electronic messages, by making a modification on your account settings page or by contacting us. Any marketing campaigns that are already underway may not immediately take your preferences into account.

We may share your Personal Information with our subsidiaries or affiliates (the “Group”) for: fraud or crime prevention, suppression or detection; to meet regulatory, legal or reporting requirements; to manage business risks; to perform analytics; to ensure that we have correct and up to date information about you; and to the extent necessary if you have requested a product or service that is jointly offered by more than one member of the Group. You may not withdraw consent for this sharing. We may also share your information to better manage your total relationship with the Group and enable other members of the Group to bring suitable products and services to your attention. We may share your information within the Group for these purposes unless prohibited by law or you tell us not to.
- Suppliers. We may share Personal Information with our suppliers, agents and other organizations that perform services for us or on our behalf to the extent necessary to provide and administer the products and services that you have requested from us. If you withdraw your consent for this sharing, we may not be able to provide you with the your requested product or service.
- Changes to this Privacy Policy
We reserve the right to change this Privacy Policy at our sole discretion. We will inform you of any such change by posting a new Privacy Policy on the Site and clearly marking the effective date of any such change to the Privacy Policy. We will not use any Personally Identifiable Information of yours in ways that are materially different from the ones described in this Privacy Policy without also providing notification of such practices and obtaining consent to any such different uses. If we make material changes to this Privacy Policy, we will notify by e-mail or by notice on the Site.
- Third-Party Sites
The Site may be linked to internet websites operated by other companies. You should consult the respective privacy policies of these third-party websites. Our Privacy Policy does not apply to, and we cannot control the activities of, such other third-party web sites. Please be aware that we do not warn you when you choose to follow a link through to another website from the Site.
- International Users
If you are a User outside of Canada, please note that we process your Personal Information on our servers in Toronto, Ontario, Canada and in other countries as may be necessary. In some cases, we process your Personal Information outside your own country. Therefore, Canadian federal and provincial governments, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your information through laws applicable in Canada. Your use of the Site or your submission of any Personally Identifiable Information to us will constitute your consent to the transfer of your Personal Information outside of your home country, which may provide for different data protection rules then in your own country.
- Complaints and Questions
- We regularly review our compliance with this Privacy Policy. When we receive formal written complaints, it is our policy to contact the complaining User regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between us and you.
